Terms of Use and Sale for the Custom Golf Balls Australia website. Last updated: 18 September 2026.
This website and online store are operated by Merch Machine (ABN 88 630 505 770), of 64 Denning St, South Coogee NSW 2034, Australia, trading as Custom Golf Balls Australia. In these Terms, "we", "us" and "our" mean Merch Machine trading as Custom Golf Balls Australia, and "you" means anyone who uses this website, creates an account or places an order.
By creating an account or placing an order, you agree to these Terms. Please read them together with our Returns & Refunds policy and our Privacy policy, which form part of these Terms.
1. About us
1.1 We are an Australian online store selling custom-decorated and personalised products made to order. We do not operate a retail shopfront and we do not accept visitors or offer collection. Our South Coogee address is a registered trading address for correspondence only.
1.2 We sell and deliver to addresses within Australia only.
2. Using this website
2.1 Through this website you can browse and buy the products listed for sale, upload artwork and create designs using our online design tool, save designs to your account, and register for an account or to receive offers.
2.2 Eligibility. You must be 18 or over to place an order. If you are under 18, a parent or guardian must place the order and accept these Terms on your behalf.
2.3 Your account. You are responsible for keeping your password confidential and for activity under your account. Tell us promptly if you believe your account has been used without your permission.
2.4 Acceptable use. You must not use this website to:
- upload, create or order anything that infringes anyone's copyright, trade marks, privacy or other rights;
- upload, create or order anything unlawful, defamatory, threatening, harassing, sexually explicit, or that promotes hatred or discrimination against any group;
- introduce viruses or malicious code, or interfere with the operation or security of the website;
- scrape, copy or harvest content or personal information from the website using automated means;
- impersonate another person or business; or
- resell access to the website or our design tool, or present the website as part of another business's website.
2.5 We try to keep the website available and accurate, but we do not guarantee it will always be uninterrupted or error-free. We may change or update the website at any time.
3. Orders and art proofs
3.1 An order placed through this website is an offer to purchase. A contract is formed when we accept your order and send your art proof.
3.2 We provide a free digital art proof for every personalised order. Nothing is produced until you approve your proof. By approving a proof you confirm that the spelling, artwork, layout and colours shown are correct.
3.3 We produce what is shown on the approved proof. We are not responsible for errors that were present in a proof you approved.
3.4 You may cancel for a full refund at any time before you approve your proof. Once you approve it, production begins and the order cannot be cancelled.
4. Artwork and designs you supply
4.1 When you upload a logo, photo, text or any other material, you confirm that you own it or have permission to use it, and that reproducing it will not infringe anyone else's rights. You are responsible for any claim that arises from material you supply.
4.2 You keep ownership of your artwork and the original designs you create. You give us permission to store, reproduce and produce that material for the purpose of preparing your proof and fulfilling your order.
4.3 We will not use your artwork, logo or design in our marketing without your written permission.
4.4 We may decline to produce any artwork at our discretion, including material that is unlawful, offensive, or appears to infringe someone else's rights. If we decline an order you have paid for, we will refund you in full.
4.5 Production quality depends on the file you supply. Low-resolution files may not reproduce well at the size of the decoration. Your art proof shows how your artwork will appear.
5. Prices and payment
5.1 All prices are in Australian dollars and include GST.
5.2 Prices, promotions and product availability may change at any time before your order is accepted. The price that applies is the one shown at checkout when you place your order.
5.3 Payment is taken in full at the time of order.
6. Production and delivery
6.1 Production times are shown on the product page or in your order confirmation and are measured from your approval of the art proof. Delivery time is additional.
6.2 We deliver to Australian addresses only. Shipping costs are shown at checkout before you pay. Delivery timeframes are estimates, and we are not responsible for delays caused by the carrier.
6.3 If a parcel is confirmed lost in transit, we will remake and resend it at our cost.
7. Returns, refunds and your consumer rights
7.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
7.2 If your order arrives faulty, damaged, produced incorrectly, or materially different from the proof you approved, contact us within 30 days of delivery. Where we are at fault, you choose whether we remake your order or refund you in full, including the original postage. Full details are in our Returns & Refunds policy.
7.3 Personalised and custom-decorated items cannot be returned for a change of mind, because they are made specifically for you. Blank, undecorated stock items may be returned for a change of mind as set out in our Returns & Refunds policy.
8. Our liability
8.1 Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
8.2 Subject to clause 8.1, we are not liable for any indirect or consequential loss, and our total liability in connection with an order is limited to the amount you paid for that order.
8.3 This website may link to other websites, such as social media. We are not responsible for the content or operation of websites we do not control.
9. Intellectual property and brands
9.1 The content of this website, including text, images, product photography and site design, is owned by or licensed to us and may not be copied or reproduced without our written permission.
9.2 Product brand names and trade marks shown on this website belong to their respective owners. We are an independent decorator. We supply genuine branded products and decorate them to order, but we are not affiliated with, endorsed by or sponsored by those manufacturers.
10. Privacy
10.1 We collect and handle your personal information in accordance with our Privacy policy and the Privacy Act 1988 (Cth). We use it to process your order, communicate with you and, if you opt in, send you offers. You can unsubscribe at any time.
11. Suspending or closing accounts
11.1 We may suspend or close an account that is used in breach of these Terms. This does not affect any order already paid for, which we will either fulfil or refund.
11.2 You can close your account at any time by contacting us.
12. Changes to these Terms
12.1 We may update these Terms from time to time and will show the date of the latest update at the top of this page. The version published when you place an order is the version that applies to that order.
13. General
13.1 If any part of these Terms is found to be unenforceable, the rest continues to apply.
13.2 These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
